1] These petitions are filed aggrieved by the condition no.2 in the appointment letters issued to the petitioners
s WP 3955/15 & another - 2 - stipulating the time till 30.3.2015 to acquire the requisite / necessary qualification.
2] The learned counsel appearing for the petitioners has tendered across the Bar the corrigendum issued by the Department of School Education and Sports, Mantralaya, Mumbai, dated 31.3.2015 in which the earlier condition to acquire the qualification by 30.3.2015 has been substituted by extending the date as 28.2.2019. 3] In view of the corrigendum issued by the said Department, the authorities cannot act upon the condition no.2 stipulated in the appointment letter dated 22.8.2014 since in view of the corrigendum issued, the said date stands extended upto 28.2.2019.
4] In the result, the impugned communications dated 30.3.2015 / 31.3.2015 would not survive and hence the same are quashed and set aside. Both the writ petitions are disposed of upon above terms. No order as to costs. (P.R. BORA, J.) (S.S. SHINDE, J.) ndk/c1041555.doc
