Heard learned counsel for both the sides finally at admission stage.

The petitioners are challenging order dated 08.03.2023 passed by the learned Member of the Industrial Court, Ahmednagar permitting the respondents to withdraw the amount. By judgment and order dated 07.12.2022, the learned Member of the Industrial Court, Ahmednagar partly allowed the appeal, setting aside the order passed by the Controlling Authority and remanding the matter for consideration afresh to it.

It is informed that there is no substantive progress after order of remand passed on 07.12.2022. Both the learned counsel are at ad-idem on fact that ends of justice would be met if the proceedings which are remanded to the controlling authority are expedited.

In that view of the matter, the writ petition is disposed of with a direction to the Controlling Authority/Labour Court, Ahmednagar to make an endeavour to finally conclude the proceedings which are remanded within a period of three (03) months from today.
