Mr.Joshi, learned counsel appearing for the petitioner, on instructions, seeks to withdraw this petition with liberty to approach the Joint Charity Commissioner, Aurangabad.

Liberty, as prayed for, is granted. However, it is made clear that if and when the application is made by the petitioner-Trust u/s 36-A of the Maharashtra Public Trusts Act, 1950, the same would be decided on its own merits without in any manner being influenced by the liberty granted by this Court.

Petition stands dismissed, as withdrawn.
