After having heard learned counsel for the respective parties, we find that on same set of facts a civil suit under Section 6 of the Specific Relief Act is pending. It would, therefore, not be desirable for the trial Court to proceed with the hearing of the criminal case. Therefore, further proceedings in R.C.C. No.92/2022, pending before the learned Judicial Magistrate, First Class, Karjat are stayed until final decision of the suit filed under Section 6 of the Specific Relief Act. With these directions, the application stands disposed of.
