Heard. Perused the F.I.R. and the related papers. The applicant and his two sons are alleged to have assaulted the informant. The applicant wielded wooden log and gave its blows on the back of the informant. It was co-accused who assaulted the informant with iron rod, resulting into fracture. Co-accused have already been arrested and even informed to have been granted bail.

Due to the assault made by the applicant, the informant suffered injury, simple in nature. The weapon used by the applicant has also been seized by the police. The

applicant is 57 years of age. Considering the role in the crime in question, the order granting interim protection to the applicant is made absolute, although the learned A.P.P. has strong objection to grant the relief. The application is allowed. 3.

The applicant shall not tamper with the prosecution evidence and shall appear before the investigating officer as and when required for the purpose of investigation. (R.G. AVACHAT, J.) fmp/-
