Heard the learned counsel for the applicant and the learned APP for the respondent/State.

The applicant has been arraigned as an accused alleging that he was found in possession of liquor bottle caps and the material required to manufacture the liquor. The alleged material has been recovered from him. He has shown the supplier of the raw material. The investigation to the extent of present applicant has been over. Therefore, he deserves bail. Hence, the following order.

ORDER

[i] The application is allowed.

[ii] Applicant - Narayan Vasudeo Ghumre be released on bail on his furnishing PB and SB of Rs. 50,000/- (Rupees Fifty Thousand) 1/2

937-BA-559-2023 with one solvent surety of like amount in Crime No. 035 of 2023 registered at Sub Inspector, State Excise Department, D-2, Paithan Division, Dist. Aurangabad, for the offence punishable under Sections 65A, C, E, F, 83, 90 and 108 of the Maharashtra Prohibition Act, 1949 and under Section 328 of the Indian Penal Code, on the following conditions.

[a] The applicant shall attend the concerned police station as and when called on written notice by the Investigating Officer, till filing the charge sheet.
