A] ORDER IN CIVIL APPLICATION FOR WITHDRAWAL 1] The present civil applications are filed for withdrawal of the amount deposited by the acquiring body in this Court.
2] The learned counsel for the applicants has produced the order dated 13th June, 2023 passed in Civil Application No.6083 of 2023 in First Appeal No.2956 of 2022 wherein this Court has permitted the applicants therein to withdraw the entire 75% amount of compensation deposited by the acquiring body. The learned counsel for the applicant further submits that amount of 75% as directed by this Court is not entirely deposited. 3] The learned counsel for the acquiring body submits that the amount is deposited in terms of the calculation.
4] In view of the same, the present applicants are permitted to withdraw entire 75% amount of compensation deposited in this Court along with interest accrued thereon till date on furnishing usual undertaking to the satisfaction of the Registrar [Judicial] of this court. Civil Applications are disposed of accordingly.
5] The applicants are at liberty to move fresh application after calculation.
B] ORDER IN CIVIL APPLICATION FOR DELAY 1] The present Civil Applications are filed to condone the delay of 500 days in filing the First Appeal. 2] For the reasons stated in the Civil Applications, the same are allowed. Delay is condoned. Appeals be registered. Civil Application is disposed of accordingly. C] ORDER IN CIVIL APPLICATION FOR STAY Since the appellant - acquiring body has deposited the amount as directed by this Court, the interim stay granted by this Court stands confirmed. Civil Applications are disposed of accordingly.
