ORDER : - 1.

The present First Appeal is listed before us in today's Lokadalat.

Both the appellants along with their learned Counsel Shri. S. S. Rathi, are present virtually. The learned Counsel for respondent No. 3 - Shri. R. H. Dahat is also present. The parties have settled the dispute and filed compromise terms, whcih are taken on record and marked as "X" for identification.

In view of the compromise terms at "X", respondent No. 3 - Insurance Company agrees to pay enhanced compensation of Rs. 4,00,000/- (Rupees Four Lakhs) to the appellants. The appellants have been verified by the panel, virtually. Hence, in view of the settlement between the parties, the following order is passed.

ORDER

[i] The appeal is allowed in terms of compromise at "X". [ii] Respondent no. 3 - Insurance Company shall deposit agreed enhanced amount equally in the bank account of the appellants within five (05) weeks from today. [iii] Appellants herein shall supply the bank account numbers to respondent No. 3 - Insurance Company within two weeks from today.

[iv] If respondent No. 3 fails to deposit the amount in the accounts of the appellants within the stipulated period, the enhanced amount shall carry interest at the rate of 8% p.a. till its realization.

[v] The Court Fee Refund Certificate be issued as per the provisions under the Maharashtra Court Fees Act, 1959.
