Applicants are mother-in-law and sister-in-law of deceased. They apprehend arrest in connection with Crime No. 0222/2024 registered with Shrigonda Police Station, District Ahmednagar, for the offences punishable under Sections 306, 498-A, 304-B, 323, 504, 506 read with Section 34 of Indian Penal Code.

First informant is the brother of deceased Malan who was married to Murli Shinde in the year 2017. Report indicates that for a year she had cordial marital life. However, thereafter, her husband, under the influence of liquor, started harassing, abusing and beating her. He used to call upon her to bring Rs. 50,000/- from her parents. Insofar as mother-in-law is concerned, there is a statement that she used to taunt her that she did not bring anything from parents in the marriage. As far as sister-in-law is concerned, it is stated that on one occasion when she had called on phone, she told the informant that let his sister remain at the parental home itself. 3.

Learned counsel for the Applicants submit that from the First Information Report itself it is clear that the major cause for the deceased to commit suicide is the harassment caused by the husband. As far as Applicants are concerned, according to them, there are no allegations which would have driven her to commit suicide.

Learned APP opposed the application by pointing out contents of the First Information Report as well as statements of witnesses.

Perusal of the First Information Report as well as police papers indicates that the major reason for deceased to commit suicide is the harassment caused by her husband to her. Record indicates that under the influence of liquor he used to beat the deceased. He was also demanding amount of Rs. 50,000/- from her parents. As against this, as far as Applicants are concerned, even contents of First Information Report are accepted against them, it cannot be said that they have driven the deceased to commit suicide. 6.

Having regard to these facts and also in view of the fact that the Applicants are ladies, both the applications stand allowed in terms of the interim order.
