ORDER:- 1.

Heard learned Counsel for the applicant. The respondent husband, despite service remained absent. 2.

The applicant is seeking transfer of Marriage Petition No.893/2013 filed by the respondent for getting divorce, from the Family Court, Pune to the Family Court, Ahmednagar. It appears that the applicant is not having any source of income. Further, the applicant has also filed criminal case against the husband and others for contracting second marriage during the subsistence of his earlier marriage. The husband and other persons have already appeared in the aforesaid proceeding. Thus, it appears that the respondent will have to attend the dates at Ahmednagar and therefore, his petition filed at Pune can be conveniently transferred to Ahmednagar Family Court. Hence, the following

(2) 980 MCA-245.2022.odt order is passed.

ORDER

(i) The application is allowed.

(ii) Marriage Petition No. 893/2013 is hereby transferred to the Family Court, Ahmednagar from the Family Court, Pune for its disposal according to law.

(iii) The respondent is directed to appear before the learned Family Court, Ahmednagar on or before 15th February 2023.

(iv) The application is accordingly disposed of.
