Learned counsel for the petitioner submits that the challenge in the petition is to the appointment of the Court Commissioner in an application filed under Order VII Rule 11 of the Code of Civil Procedure for ascertaining the market value of the property for the purpose of determining the court fees payable. He further submits that the Court Commissioner has executed his Commission and has ascertained the market value. As such, nothing survives for further consideration. 2.

Writ Petition is accordingly disposed of as withdrawn. 3.

Learned counsel for the petitioner points out that, in an application for review, the Civil Judge, Senior Division has expedited the matter.
