PER COURT :- Learned counsel appearing for the petitioner contends that the provisions of section 3-D are not attracted to the PVR Multiplex theatre operated by the petitioner and as such, the impugned order is prima facie bad in law. However, since the statutory appeal has been presented to the Commissioner (Entertainment), Aurangabad, we leave the issue for consideration of the Appellate Forum. Petitioner apprehends coercive action at the hands of respondents and seeks protection until the decision on the interim relief application presented by the petitioner to the Appellate Forum.
In the facts and circumstances of the case, we direct the Commissioner(Entertainment), Aurangabad before whom appeal has been presented to decide the application, seeking interim orders presented by the petitioner, as expeditiously as possible and preferably within a period of ten days from today. Respondent shall not take any coercive action against the petitioner for a period of ten days. With the direction as above, writ petition is disposed of. ( K.L. WADANE, J. ) ( R. M. BORDE, J. ) vbd
