Heard the learned counsel for the applicants and the learned APP for the respondent-State.

The applicants are seeking bail in Crime No.49 of 2023, registered with Muktainagar Police Station, District Jalgaon, for the offences punishable under Section 363, 364-A of the IPC.

The facts reveal that the complainant had received Rs. 4,00,000/- from the accused against the Jadibuti for the heart.
However, it was revealed that it was not a genuine medicine. Hence, the applicants were demanding, complainant their money back. It appears that out of Rs.4,00,000/-, Rs.3,00,000/- have been paid to the accused Mahesh. The son of the complainant allegedly kidnapped and was taken in the custody. Looking to the nature of the dispute and the progress in the investigation, the Court is of the view that further detention of the applicants would serve no purpose. Hence, the following order :
O R D E R
(i) Bail Applications are allowed.
(ii) Applicant MAHESH NAMDEO PATIL in Bail Application No.560 of 2023 and applicant Nos.
1. PANKAJ BABURAO SALATE and 2. AMOL MANOHAR RASAM in Bail Application No.561 of 2023, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) each with one solvent surety of the like amount each, in Crime No.49 of 2023, registered with Muktainagar Police Station, District Jalgaon, for the offences punishable under Section 363, 364-A of the IPC, on the following conditions :
(a) The applicants shall submit their residential proof and the mobile numbers with an undertaking that they will not change the mobile numbers and inform the Investigating Officer about the change in address, if any, till conclusion of the trial. (b) They shall attend the Police Station as and when called on written notice by the Investigating Officer till filing charge sheet. (S. G. MEHARE, J.) ...
