Heard the learned counsel for the applicant and the learned APP for the State.

The victim was 17 years and 11 months old at the time of the incident. The statement of the victim was that her parents were threatening to kill her and the applicant. She had completed 18 years of age at the time of incident. She has love affair with the applicant. She went with the applicant at her own. Her statement is clear that the applicant did not entice her to go away from the custody of her parents. She claimed that she was 18 years old at the time of incident. The investigation is over. No purpose would be served keeping the applicant behind the bars. Hence, the following order :

O R D E R
(i) The application is allowed.
(ii) The applicant Yogesh Dattu Barde be released on bail on furnishing P.B. and S.B. of Rs.15,000/- (Rupees Fifteen Thousand only) with one solvent surety of the like amount in Crime No.312 of 2021, registered by Police Station Kopargaon City, District Ahmednagar, for the offences punishable under Sections 363, 366, 494 of the IPC, on the condition that he shall not tamper with the prosecution witnesses.
