1] Heard learned counsel for the applicants and the learned APP for the respondent-State.

2] The applicants are approaching this Court apprehending arrest in connection with Crime No. 40/2025, registered with Mehunbare Police Station, District Jalgaon, for the offence punishable under Sections 108, 351 (2), 351 (3), 3 (5) of the B.N.S., 2023.

3] It is alleged in the FIR that on 04.08.2023, the informant and his brother handed over Rs.3 lacs to Samir Khandarkar for investment. It is alleged that later on money was asked from the accused, instead of giving money back to the informant, the accused persons have threatened the informant that they would file case under the provisions of

Money Lending Act. It is further alleged that due to said threats, the brother of the informant has committed suicide on 09.10.2024 by hanging himself with the help of rope. On the basis of said allegations, the FIR is lodged. 4] The learned counsel for the applicants submits that the applicants are not involved in the alleged crime. The alleged transaction was exclusively in between accused Samir and informant only. The applicants are only the associates of Samir Khandarkar. Considering the allegations in the FIR, Section 108 of the B.N.S. would not attract against the present applicants.

5] Considering the submissions of the applicants, the applicants are granted anticipatory bail in the following terms :- i] In the event the applicants are arrested in connection with Crime No.40/2025, registered with Mehunbare Police Station, District Jalgaon, for the offence punishable under Sections 108, 351 (2), 351 (3), 3 (5) of the B.N.S., 2023, they shall be released on bail on furnishing PR bond of Rs.20,000/- each, one or two sureties in the like amount to the satisfaction of the trial Court.

ii] The applicants shall attend the concerned police station from 16.04.2025 and 17.04.2025 between 10.30 a.m. and 1.30 p.m.

iii] The applicants shall not tamper with the evidence of the prosecution in any manner. They shall not influence the informant, witnesses and other persons concerned with the case.

iv] The applicants shall co-operate with the investigation and also in the proceedings before the trial Court.

6] In the event, the applicants violate any of the conditions specified in this order, it shall be liable to be cancelled.

7] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.

8] The application stands disposed of.
