DATE : JULY 13, 2022 ORDER :- This is an application under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0026 of 2022 registered with Jintur Police Station, Dist.Parbhani, for the offences punishable under Sections 307 and 504 read with Section 34 of Indian Penal Code.

Heard learned counsel appearing for the parties. 3.
Learned APP would submit that the name of the applicant has been figured in the FIR. He has assaulted the victim with two knife blows on the vital part of the body. It would, therefore, not be desirable to grant him bail.

Learned counsel for the applicant would submit that the applicant is just 20 years of age. The victim has been discharged from the hospital. The applicant is ready to abide by any of the conditions which the Court may impose.

Considered the submissions advanced. Perused the FIR. 6.
The applicant assaulted the victim with two knife blows on his chest. The victim has been discharged from the hospital on tenth day of the incident. On completion of the investigation, charge sheet has been filed.
It will necessarily take time for commencement and conclusion of the trial. Considering the age of the applicant, it is desirable to grant him bail with some conditions. 7.
Hence, the order:- (i) The application is allowed.
(ii) The applicant be released in connection with Crime No.0026 of 2022 registered with Jintur Police Station, Dist.Parbhani, for the offences punishable under Sections 307 and 504 read with Section 34 of Indian Penal Code, on executing P.R. Bond in the sum
10-BA.522.2022 of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount.
(iii) The applicant shall not tamper with the prosecution evidence in any manner.
(iv) He shall not enter town Jintur, Dist. Parbhani, for next twelve months.
