Learned Advocate for the respondents has circulated this matter for seeking disposal in the light of the settlement between the parties.

Mr.Sangit, learned Advocate places on record a communication received from Prasad Digambar Belapurkar, who is the son of the petitioner Digambar Belapurkar. The said communication is marked as Exhibit "X" for identification.

Mr.Sangit submits that the son of the petitioner indicates in Exhibit "X" that the petitioner has passed away on 09/02/2015. khs/Jan.2016/5152-d
Parties have settled the dispute between themselves and as a consequence of which First Appeal No.684/2007 has also been disposed of in terms of the consent / settlement by order dated 05/05/2015. A copy of the said order dated 05/05/2015 delivered by this Court in First Appeal No.684/2007 is taken on record and marked as Exhibit "Y" for identification.

None appears for the petitioner even at the second call. 5.
