On the earlier occasion, we had directed the learned AGP to take instructions as to whether, Respondent No.2/ Sahityaratna Lokshahir Annabhau Sathe Vikas Mahamandal Maryadit is functional and because of certain incidents reported of misappropriation of public funds. On the request of the learned AGP, we had granted time till today. Today, the learned AGP informs us, on instructions, that though this Mahamandal is a Government of Maharashtra enterprise, but on account of misappropriation of funds, the criminal prosecution has been launched and investigations are going on. The State CID has seized not only the documents, but also certain amounts. The Mahamandal is trying to make an application and also is in continued correspondence so

*2* 2wp5244o17 as to enable it to disburse the amounts and in accordance with the Rules. However, presently there is no disbursement of any sums and it is not likely that the disbursement will commence in near future unless the competent criminal court passes requisite orders. The copy of the written communication addressed to the learned AGP is taken on record and marked as "X" for identification. In such circumstances, it is futile to direct to consider any representation of the Petitioner. However, if the Mahamandal becomes functional in future, reserving liberty as is available in law to make a fresh application and seek requisite assistance, we dispose of this Writ Petition. kps (MANGESH S.
