Petitioner has been disqualified in view of Section 10(1-A) of Maharashtra Village Panchayat Act, as she could not produce caste validity certificate within stipulated period.

Learned Advocate appearing for petitioner submits that petitioner's claim for caste validity is still pending before the competent authority and despite her efforts, the same could not be decided within stipulated time. Therefore, there is no fault on the part of petitioner. 3.

The aforesaid contention of the petitioner cannot be accepted in view of mandatory provisions under Section 10(1-A) of Maharashtra Village Panchayat Act. It is not in dispute that election of petitioner took place and she was elected in the year 2021. Therefore, even she cannot take benefit of Maharashtra Ordinance No-3 dated 01.08.2022. 4.

In that view of the matter, there is no merit in present petition. Hence, writ petition stands rejected.
