Issue notice to respondent, learned AGP for both respondents. 3.

Present application is filed by applicant seeking permission to bring on record proposed L.Rs of the deceased appellant, namely Babasaheb Chaudhari on record.

In view of the nature of the subject-matter and reasons mentioned in the application, there is no impediment to allow the proposed L.Rs. of the deceased appellant to cause his appearance on record being appellant in this matter. Hence, application stands allowed in terms of prayer clause "B" to "D". The delay stands condoned. The order of abating the appeal, if any, is hereby quashed and set aside. The applicant to carry out necessary amendment within two weeks from today.
