The Petitioner desires that the District Collector be directed to decide a Review Application filed on 01.10.2020. The learned AGP submits that the District Collector does not have the power of review under Section 308 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965. 2.

The learned Advocate for the Petitioner submits that the Petitioner desires to withdraw this Petition and prefer an appropriate proceeding before the superior authority as against the order of the District Collector. The learned AGP submits that no such remedy would now be available to the Petitioner in view of Section 14 of the

- 2 - wp3876.24.odt Limitation Act and the law laid down by the Hon'ble Supreme Court in the case of P. Sarathy vs. State Bank of India, AIR 2000 Supreme Court 2023.

We would not make any observation on the request of the Petitioner. This Writ Petition is disposed off, as withdrawn on instructions.
