Heard learned Advocates for the parties. Both the appeals are arising out of common judgment and award and therefore these appeals are taken up together. The challenge is to a common judgment and award dated 30.09.2003 passed by the learned Civil Judge, Senior Division, Osmanabad in LAR No. 83 of 1995 and 84 of 1995. By way of the judgment and award, the learned Civil Judge, Senior Division has enhanced amount of compensation from Rs.1724/- per R to Rs. 3465/- per R. The land of the respondents-claimants came to be acquired for Upper Manjara Medium Project, Ieet, Tal. Bhoom. 02.
The Government of Maharashtra now taken a decision vide Government Resolution dated 03.11.2016 with Corrigendum dated 23.02.2017, not to file appeals where the amount of compensation is less
( 2 ) fa1843.08 than four times of the amount awarded by the Special Land Acquisition Officer. In the present case, it is found that the amount is enhanced approximately twice the amount awarded by the Special Land Acquisition Officer.
03.
Considering the above, this Court finds that keeping the appeals pending would not serve any purpose. Therefore, both the First Appeals are disposed off with no order as to costs. [KISHORE C. SANT, J.] snk/2025/Aug25/fa1843.08
