Heard learned counsel for the applicant and the learned APP for the Respondents/State.

The applicant is apprehending the arrest in connection with Crime No.0190/2020, registered with Pathardi Police Station, District Ahilyanagar, for the offence punishable under Sections 323, 395, 504 and 506 of the Indian Penal Code.

From the allegations in F.I.R., it appears that the applicant has demanded Rs. 100/ from the complainant and the complainant refused to pay the same, hence he abused the informant and assaulted with fist and kick blows and also slapped him. He also snatched Rs. 27,900/- by

putting knife on his stomach and threatened to kill him. 4.

In the instant case, F.I.R. is registered after two days of the incident and the informant was not medially examined. Prima-facie from the F.I.R., it appears that there was scuffle between the parties on account of some accident.

Learned APP submits that there are two eye witnesses. 6.

Considering the same, interim protection was granted to the complaint and, also, considering that no injury is suffered by the informant, prima facie, there is possibility of implication of the applicant.

Considering the submissions, application is allowed in terms of following terms :- A] The applicant is arrested in Crime No.0190/2020, registered with Pathardi Police Station, District Ahilyanagar, for the offence punishable under Sections 323, 395, 504 and 506 of the Indian Penal Code, he shall be released on bail on furnishing PR bond of Rs.20,000/-, with one or two sureties in the like amount.

B] The applicant shall co-operate with the investigation and to attend the Police Station as and when called by the Investigating Officer.

C] The applicant shall not influence the informant, witnesses or any person concerned with the case and he shall not tamper with the evidence.

Needless to say, violation of any of the aforesaid conditions may result in this order being cancelled.
