By the present application, the applicant is seeking pre-arrest bail in connection with Crime No. 033/2017 registered with Bembali Police Station, District Osmanabad, for offence punishable under Section 306, read with Section 34 of the Indian Penal Code.

(Order) (2) Cri. Appln. No. 01678 of 2017 02.

Learned Advocate for the applicant has argued for ad interim pre-arrest bail. He has produced copy of the order passed on 27.03.2017 in Criminal Application No. 1602 of 2017. By the said order, the applicant therein is granted ad interim pre-arrest bail in the same crime.

Present applicant is also working in the same office. In that view of the matter, this Court holds that the present applicant is entitled for ad interim pre-arrest bail.

Hence, till the next date of hearing, in the event of arrest of the applicant in the above crime, he be released on ad interim pre-arrest bail on his executing P.B. & S.B. of Rs. 15,000/- [Rupees fifteen thousand], on the following conditions :- (i) The applicant shall attend the concerned Police Station on 02nd, 03rd and 04th days of April 2017, between 09.00 a.m. to 12.00 noon and he shall co-operate the Investigation Officer in investigation of the crime in question.

(ii) The applicant shall not contact any of the prosecution witnesses and he shall not tamper with the prosecution evidence in any manner whatsoever.

(Order) (3) Cri. Appln. No. 01678 of 2017 (iii) The applicant shall not indulge in commission of similar offences.

Issue notice to the non-applicant - State of Maharashtra.

Learned Addl. Public Prosecutor waives service of notice on behalf of the non-applicant. He undertakes to produce papers of investigation and to argue the matter on the next date.

Stand over to 06th April 2017.

Keep along with Criminal Application No. 01602 of 2017.
