Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant seeks bail in Crime No.192 of 2023, registered with Pundliknagar Police Station, District Aurangabad, for the offences punishable under Sections 307, 452, 354, 143, 147, 148, 149, 323, 504, 506 of the IPC and Section 135 of the Maharashtra Police Act.

It has been alleged against the applicant that he assaulted the injured with knife and caused him injury on cheek and neck. Fortunately, the injured was survived. He was treated immediately and discharged from the hospital. There was a dispute about identification of the applicant. The photographs placed on record by the prosecution support the

allegations against applicant. The weapons have been recovered from the applicant. He has bad history. However, he has been acquitted from the offences of 2019. The applicant is not the resident of the locality where the incident happened. The trial may take its time. No material investigation is to be done from him. In view of the above, if the bail is granted, it would not harm the prosecution. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant AJAY GULABRAO RAGADE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the following conditions :

(a) The applicant should not tamper with the prosecution witnesses.

(b) He should attend the trial on each and every date.

(c) He should not contact the injured or any witnesses in any mode or manner till conclusion of the trial.

(d) He should not enter Pundliknagar area till the conclusion of the trial.
