The present application is filed seeking recall of the order dated 13.02.2020 passed by this Court in, by which the Writ Petition No.1863 of 2006 has been dismissed in default with costs of Rs.5,000/- payable to respondent No.1.

Mr. S.E. Shekade, learned Advocate appearing for the applicants submits that the costs of Rs.5,000/- is already deposited in this Court.

920_CA_3838_2023 Apparently, the present application for restoration is filed after two years. However, considering the reasons as stated, the application stands allowed in terms of prayer clause 'B', subject to condition that the applicants do pay the costs of Rs.10,000/- (Rupees Ten Thousand only) to respondent No.1, within the period of two weeks from today. On deposit of costs, respondent No.1 shall be at liberty to withdraw the same along with the costs of Rs.5,000/- deposited earlier. ( S.G. CHAPALGAONKAR ) JUDGE agd
