This is an application seeking suspension of substantive sentence imposed upon the applicants by the learned Judicial Magistrate, First Class, Muktainagar in R.C.C. No. 63 of 2012 vide judgment and order dated 10th April, 2013. The said judgment is partly confirmed by the Appellate Court. The learned counsel for the applicants submits that the applicants have undergone the substantial period. Applicant No.1 Chattan Ramesh Pavar has served the sentence of 318 days i.e. one year and fifteen days whereas applicant No.2 has also undergone the substantive sentence for 318 days. In view of the
( 2 ) cria1808.15 fact that the revision application is admitted. The applicant herein deserves to be enlarged on bail during the pendency of the revision application.

Hence the following order is passed.

The substantive sentence imposed upon applicants in R.C.C. No.63 of 2012, confirmed in Criminal Appeal No.168 of 2014 by the Additional Sessions Judge, Bhusawal is hereby suspended. They be enlarged on bail on furnishing P.R.Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) and one or two sureties in like amount. The applicants shall mark their attendance before the Judicial Magistrate, First Class, Muktainagar, once in six months on the date scheduled by the learned Court. Upon failure to do so, the prosecution would be at liberty to file application seeking cancellation of bail. 3.
The Criminal application is accordingly allowed and disposed of.
