For the first time on 12.11.2025, this application was listed on the Board and on that day, since none appeared for the applicant, this matter was adjourned.

Today, learned advocate Shri Paikrao appears on behalf of the applicant and states that the applicant has taken the brief and no objection from the advocate on record. However, when that exercise has taken place, is not known to learned advocate appearing today.

The applicant is challenging the complaint proceeding under Section 138 of the Negotiable Instruments Act, which is registered as SCC No.10140/2019 pending on the file of learned JMFC, Aurangabad. The instant application is filed in the year 2020 and was never circulated and listed thereafter. There is no stay granted by this Court, meaning thereby, lower court proceedings have proceeded far ahead. Official website discloses that the proceedings before lower Court are now pending for evidence of defence side. The applicant is alleged to have taken his brief and has not taken care to engage another advocate till date. In such circumstances, I am not inclined to entertain this application.

In view of the above, this Criminal Application is dismissed. However, in the event, the applicant is aggrieved by any further order, he is at liberty to file appropriate proceedings. kps ( SUSHIL M. GHODESWAR, J. )
