Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is seeking bail in Crime No.19 of 2023, registered with Police Station Biloli, District. Nanded, for the offences punishable under Sections 399, 307, 353, 279, 427, 402 of the IPC and Section 4/25 of the Arms Act. 3.

Admittedly, the applicant was not present on the spot of the incident. He has been arraigned as an accused only for the reason that he was the owner of the vehicle involved in the alleged crime. It has also been alleged against him that at his direction, the other co-accused went to commit dacoity carrying deadly weapons in the vehicle owned by him. However, none of the police officer was injured.

932-BA.573-23.odt Considering the allegations levelled against the applicant, he deserves bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant FIROZ MUSTAQ ANSARI be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.19 of 2023, registered with Police Station Biloli, District. Nanded, for the offences punishable under Sections 399, 307, 353, 279, 427, 402 of the IPC and Section 4/25 of the Arms Act, on the following conditions :

(a) The applicant shall attend the Police Station as and when called on written notice by the Investigating Officer till filing charge sheet. (b) He shall not tamper with the prosecution witnesses.
