The present application is filed seeking permission to the applicants to utilize the service of mathadi workers for lifting the 750 metric tons food grain from Jalgaon Godown of Maharashtra Warehousing Corporation and load the same in the vehicles made available by the Collector.

The interim order passed is explicitly clear. We have not restrained the present applicants from utilizing the services of mathadi workers for the purpose of loading. The order dated 28.03.2016 only states that the fresh transportation may not be done till the next date. The restrain on the fresh transportation is pursuant to the tender i. e. the subject matter of writ petition. If any separate agreement is between Collector and any other person, the same is not subject matter of present writ petition. The order passed on 28.03.2016 is limited to the work order issued pursuant to the present tender under challenge with regard to the non transportation pursuant to the tender. 3.

Mr. Suryawanshi, the learned counsel states that, present tender also includes the work of handling at the warehouse. The civil application is disposed of.
