PER COURT :- Learned counsel for the applicant submits that this Court, vide order dated 8.8.2016 permitted applicants in connected Appeals to withdraw the compensation amount on certain conditions. The applicants herein, may be permitted to withdraw the amount of compensation on the same conditions. Learned counsel appearing for respondent acquiring body has no objection if the applicants herein are permitted to withdraw the compensation on the same conditions. The applicants are permitted to withdraw 50% of the total amount on submitting an undertaking that in the event any adverse order is passed against them, they shall redeposit the said amount within four weeks from the date of such order. The applicants are further permitted to withdraw 25% of the amount deposited, on furnishing solvent surety in the like amount.
The balance 25% of the amount shall be invested in FDR in any nationalized bank initially for a period of three years with a further direction to renew the said FDR if so required, till decision of the present appeal. The Civil Applications are disposed of accordingly. The First Appeals are heard and admitted.
Learned AGP waives service on behalf of respondent Nos.1 and 2. Call Record and Proceedings.
