Petitioner No.1-Rajaram Bapurao Shinde died on 1004-2013 during pendency of this petition. The learned advocate for the petitioners had no occasion to contact the petitioners. The petitioners had no knowledge that the legal heirs of petitioner No.1 is require to be taken on record. It is only in the month of February, 2023 they got the notice as their advocate came to be elevated as Judge. It is thereafter they approached their lawyer. In this process 3539 days delay is caused in filing

Considering the reasons, the delay needs to be condoned and same is hereby condoned. The application stands allowed.

The petitioners to carryout the amendment within four weeks.
