Learned Counsel Mr. R.U. Gavhane holding for Mr. Badakh Vishal S. for the appellant alongwith appellant - Ankush Kisan Chavhan and Mr. S.R. Bodade holding for Mr. Ajit B. Kadethankar, learned Counsel for the respondent no.2/Assurance Company are present before the Panel today. They tender on record the terms of settlement which is marked as 'Exhibit-X' for identification. 3.

With the assistance of learned Counsels, we have ascertained the identification of appellant/original claimant who confirms the terms of settlement.

Parties before the Panel pray to dispose of the first appeal in terms of settlement at Exhibit-X.

NOB-FA-417-2019 -25.

As per the terms of settlement, the respondent no.2/ New India Assurance Co. Ltd., shall deposit an additional amount of Rs.1,00,000/- (Rupees One Lakh only) towards full and final settlement in this Court within a period of six weeks from today. The same shall be treated as an Undertaking.

On depositing the amount, the same alongwith accrued interest, shall be disbursed to the appellant. 7.

The First Appeal is disposed of in terms of compromise at Exhibit-X and the minutes of the order passed today. 8.

The Court fees shall be refunded as per rules. 9.

Award be drawn up accordingly.

Civil Application pending if any, is disposed of. 11.

Record and Proceeding if any, be remitted back to the concerned Court/Tribunal.
