This is the first appeal filed by the Acquiring Body namely Godavari Marathwada Irrigation Development Corporation. The Acquiring Body is represented today by advocate Mr. B. R. Survase along with Shri Sanjay Vishnupant Jewalikar, Executive Engineer, Lower Terna Canal Division No.2, Latur. Mr. A. M. Phule, AGP for the respondent-State and advocate Mr. B. K. Pawar for respondents/ claimants, are present.

In this mater the Acquiring Body has challenged the award passed by the learned Reference Court granting enhancement of compensation to the house property acquired by the Acquiring Body

2 sr. no.159.odt for the project Lower Terna Canal Division. The officer present made a statement that the decreetal amount is already paid to the original claimants and the decree passed by the Reference Court is acceptable to the Acquiring Body. In view of the said statement by Advocate Shri. B. R. Survase, the present appeal is disposed of. No order as to costs.

The court fee if any paid in the appeal, shall be refunded back according to rules. If there is any civil application/s pending, the same stand/s disposed of.
