ORAL JUDGMENT:- 1.

In the petition, the Information Officer of the office of Director of Education has challenged the order of Information Officer and also the State Information Commissioner by which penalty of Rs.250/- per day for causing delay in supplying information is imposed. Both the sides are heard. The

914WP_3583_2007 (2) submissions made by the learned counsel for original complainant shows that, he wants only to receive the information and has no grievance against the petitioner. In view of the nature of allegations and the nature of information sought this Court hold that the order of penalty needs to be set aside. The Writ Petition is allowed. The order of penalty is set aside. Rule made absolute in those terms.
