The application is filed for quashing of the F.I.R. of C.R. No.3008 of 2005 registered in Kranti Chowk Police Station, Aurangabad under section 7, 8, 13 (1) (5) read with section 13 (2) of Prevention of Corruption Act, 1988. 2.

Heard learned counsel for the Applicant. No need was felt to issue notice to the other side in view of the contents of the F.I.R.

The F.I.R. was given by Officer of A.C.P. Complaint was received from Shaikh Fazal Shaikh that for getting

-:(2):- mark memo present applicant had demanded the illegal gratification of Rs.500/-. After receipt of the complaint, confirmation Panchanama was prepared and it was ascertained that there was really the demand. During confirmation Panchanama the demand of Rs.400/- was made as illegal gratification. When the trap was laid on 21st January, 2015 tainted amount of Rs.400/- was accepted as illegal gratification by the present applicant. Anthracene powder was detected on the fingers of the hand of the present applicant. Thus, the recovery of the amount was made from the possession of the applicant. In view of the circumstance, there is no need to see the other record and there is no need to issue notice to other side. Applicant stands dismissed.
