Heard the learned counsel for the applicant, the learned A.P.P. for the respondent/State.

The learned A.P.P. has confirmed the fact that the Investigating Officer has filed "B" summary report in favour of the applicant. However, she would submit that it is not yet accepted. Prima facie facts before the Court are that the police is not going to file chargesheet against the applicant. Therefore, the custodial interrogation of the applicant is not required.

In the aforesaid state of facts, the application deserves to be allowed. Hence, the following order :-

14-ABA-272-21 (2) i) The application is allowed.

ii) The order dated 18.03.2021 granting interim protection to the applicant is confirmed on the same terms and conditions. 4.

None present for the applicant in Criminal Application No. 826 of 2021. However, in the facts and circumstances of the case as observed above, the application stands disposed of. (S. G. MEHARE, J.) amj
