Mr A.S. Usmanpurkar, learned counsel for the appellant on instructions seeks leave to withdraw this appeal. Leave granted. 2.

Mr Manoj Shinde, learned counsel for respondent No.1 remained absent, when the matter is called out.

Respondent No. 2 though duly served, none present for respondent No. 2.

The appellant/insurance company has deposited the entire amount of compensation with the Commissioner for Employee's Compensation and Judge, Labour Court, Latur and respondent No.1 has withdrawn 50% of the amount of compensation.

The appeal is at nascent stage. There is no hurdle to grant permission to withdraw the appeal.

ORDER

(I) The appeal stands disposed of as withdrawn.

(II) Respondent No.1/original claimant is hereby permitted to withdraw 50 % of the remaining balance amount of compensation lying with the Commissioner for Employee's Compensation and Judge, Labour Court, Latur (III) Court fee refund certificate be issued in favour of the appellant/insurance company as per rules.

(IV) Record and proceedings be sent back to the concerned Court. (V) No order as to costs.
