Heard the learned counsel for petitioner, the learned APP and the learned counsel for respondent Nos.7 to 9. The learned APP submits that she has received the instructions from the Assisting Engineer, Grade-I, Public Works Department that the road, which is subject matter of this writ petition, has been cleared for traffic. Hence, the writ petition has become infructuous.

The letter dated 21st January, 2022 is taken on record and marked as 'Article-A' for identification.

The learned counsel for petitioner, on instructions, submits that the road has been cleared for traffic. He further submits that the petitioner wish to raise other issues.

988 WP.1064.2023.odt The learned counsel for respondent Nos.7 to 9 submits that the appropriate order may be passed as the road, which is subject matter of the writ petition has been cleared. Hence, this writ petition has become infructuous.

I have heard all the learned counsel. The subject matter of this petition is clearing of the road for petitioner to going to his field. As per the letter of the Assistant Engineer, the said road has been cleared for traffic, so the petitioner can use it. In case of other issues of the petitioner, if the contentions of all the parties are kept open, it would suffice. Hence, I pass the following order:
