PER COURT :- 1.

The petition raises a grievance in respect of encroachment allegedly committed by respondent nos. 6 to 9 on the Government land.

This Court, in an earlier writ petition, issued directions to the respondent authorities to remove the encroachment over Government land, and in compliance thereof, it is informed by respondent no.3 Tehsildar, Parali, that encroachment made by the respondent no.6 on the Government land being Gat No.343 has been removed on 5.4.2014 after serving notice to the concerned persons.

It is further pointed out that so far as respondent nos. 7, 8 and 9 are concerned, they are occupying portion of Gat No.403 agp/-

BENCH AT AURANGABAD (2) CP NO.227/2014 and not Gat No.343 which is a Government land. Since respondent nos. 7, 8 and 9 are not occupying Government land, there is no question of removing them out of the possession of the area occupied by them.

In view of the aforesaid reply tendered by respondent no.3, nothing survives in the Contempt Petition. Contempt petition stands disposed of. Notices issued earlier stand discharged.
