DATED : 9th APRIL, 2015 P.C. :- The Resolution tendered by the petitioner in respect of change of nominee has not been accepted by the Returning Officer/Election Officer for Nanded District Central Co-operative Bank Ltd. and respondent No.6 Assistant Registrar, on the ground that the same was tendered belatedly. In view of Rule 10 of the Election Rules, the Resolution has to be presented 5 days prior to the last date prescribed for filing of nomination papers. However, in the instant matter, Resolution has been tendered beyond prescribed date and as such respondents are justified in refusing to entertain the request made by the petitioner. In the exercise of writ jurisdiction under Article 226 of the Constitution, no interference is called for. Writ Petition stands rejected.
