VERSUS

VIRENDRA SINGH, THE COLLECTOR AND DISTRICT MAGISTRATE, AURANGABAD AND OTHERS ...

Advocate for petitioner: Mr. G.K. Naik Thigle GP for respondent/State:Mr.A.B. Girase ...

CORAM: S.S.SHINDE & K.K. SONAWANE, JJ.

Dated: March 27, 2017 ...

Heard the learned counsel appearing for the petitioner and the learned Government Pleader appearing for the respondent/State.

2.

The learned Government Pleader appearing for the respondent/State has tendered across the Bar copy of the letter written by the Joint Secretary, Public Works Department, Government of

223.16CP Maharashtra dated 22nd March, 2017 to the Secretary, Maharashtra Public Service Commission, Bank of India Building, Mahatma Gandhi Road, Mumbai, wherein the approval is sought for removal of Shri. D.R. Kalamb as a Sectional Engineer from the services of the State of Maharashtra. The same is taken on record and marked as `X' for identification purpose.

3.

The contention of the learned counsel appearing for the petitioner that, yet the approval is not granted by the Maharashtra Public Service Commission, and therefore, this Petition may not be disposed of, has no force, in as much as, the State Government has taken the final decision at its end and sent it for confirmation/approval of the Maharashtra Public Service Commission. In that view of the matter, in our opinion, further adjudication of this Contempt Petition is not necessary. Hence, the Contempt Petition stand disposed of.
