The petitioners and the contesting respondent are personally present before this Court.
It is conveyed to this Court that now the parties are ready to act upon the order passed by the learned SDO, which is impugned in the petition. The parties are also ready to go for measurement of their respective lands i.e. land Gat Nos.369 and 370 of village Dev Takali, Taluka Shevgaon, District Ahmednagar.
914 WP.3631.2024.odt During the course of argument, it appears that the only concern of the contesting respondent, who appears as party-in-person, is that there was compromise between the parties before the SDO that 4 feet width road available from both the sides and for want of measurement, the road would exactly demarcated.
In view of the same, this Court finds that the following order shall take care of the interest of both the sides:-
O R D E R
I.
Both the petitions stand disposed of, in view of the submissions recorded in this order.
II.
The parties shall get their respective lands measured i.e. land Gat Nos.369 and 370 of village Dev Takali, Taluka Shevgaon, District Ahmednagar, within two months from today by paying the requisite charges of the land record office on urgent basis, if not already paid.
