ORDER

Learned counsel for the appellant along with his client Mr. Arjun Tanhaji Mache, and learned counsel Mr. Deshmukh for the respondent no. 2 along with representative of the respondent no. 2 Mr. Yogesh Sonawane, Executive Officer, Bajaj Allianz General Insurance Co. Ltd., are present today.

Identification of appellant is done with the assistance of learned Counsel. Appellant confirms the settlement terms. 3.

The parties have placed on record the terms of settlement which is marked as exhibit 'X'. They pray to dispose of First Appeal in terms of the settlement. The permission is ganted. 4.

As per the terms of settlement, the respondent no. 2 - Insurance Company, shall disburse the balance amount of Rs. 3,50,000/- (Rupees three lakhs fifty thousand) towards full and final settlement to the appellant within the period as stipulated in the above stated terms. It shall be treated as undertaking. The

appellant is permitted to withdraw the amount deposited with the Registry of High Court.

The First Appeal is disposed of, in view of terms of settlement at exhibit 'X'. The request of the appellant for refund of the Court fees shall be processed and considered by the office, in accordance with law.
