After having heard the learned Advocate for the revision applicant at length, without touching to the merits of the matter, the Court is not inclined to interfere with the order impugned herein since the application under Order 7 Rule 11 of the Code of Civil Procedure was moved when the matter/suit was reserved for judgment.

It is informed that over 7 - 8 months have passed after the matter has been reserved for judgment. It is also informed that the learned Presiding Officer has now been transferred.

In any case, the Court seized with the matter will be required to hear the arguments of learned Advocate for the plaintiff. It is expected and hope that the learned Presiding Officer will also give opportunity of hearing to the learned Advocate for the MSEDCL before deciding the suit on its own merits.
