Heard learned Counsel for applicant - wife. The respondent husband though served with notice but remained absent.

The applicant - wife is seeking transfer of Marriage Petition No. 28 of 2023 pending in the Court of District Judge - 6 and Additional Sessions Judge, Kalyan, Dist. Thane filed by respondent - husband for getting divorce to the Court of District Judge - 1, Shrirampur, Dist. Ahemadnagar. 3.

According to applicant - wife, she is not having any independent source of income and maintaining her three years old daughter without any financial support from the Pooja K.

970-MCA-98-2023 respondent. She has also filed proceeding under the provisions of Protection of Women from Domestic Violence Act, 2005 against the respondent - husband. Further,the distance between Kalyan and Shrirampur is about 250 KMs. There is no oppose to the application and, therefore, considering convenience of applicant, following order is passed :-

ORDER

(i) The application is hereby allowed.

(ii) Marriage Petition No. 28 of 2023 pending in the Court of District Judge - 6 and Additional Sessions Judge, Kalyan Dist. Thane is transferred to the Court of District Judge - 1, Shrirampur, Dist. Ahemadnagar for disposal according to law.

(iii) The respondent is directed to appear before the District Judge - 1, Shrirampur, Dist.

Ahemadnagar, on or before 10th July, 2023.
