The applicant/appellant herein has been convicted for the offence punishable under Section 394 read with Section 397 of Indian Penal Code and sentenced to undergo rigorous imprisonment for ten years and to pay a fine of Rs.10,000/-, in default, to suffer rigorous imprisonment for ten months.

The substantive sentence of the co-accused has been suspended by this Court. On the ground of parity and for the reasons given in the order dated 31.03.2022 in Criminal Application

16-Cri.Appeal.No.277.2022 No.1088 of 2022 in Criminal Appeal No.234 of 2022, present application is allowed.

During pendency of the appeal, the substantive sentence of imprisonment to stand suspended. The applicant be released on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. [R.G. AVACHAT, J.] KBP
