The appellant No.2 was on bail, however, now, the learned Advocate for the appellants is submitting the death certificate of appellant No.2 Bhagaji Shivram Wafare. The death certificate is taken on record and marked as Exhibit-'X'. It is stated that appellant No.2 expired on 26.01.2020. Under the said circumstance, the appeal stands disposed of as abated against appellant No.2.

The appellant No.3 - Dnyandev Wafare in Criminal Appeal No.360 of 2017 has filed Criminal Application No.1198 of 2023 for filing separate appeal in view of the fact that he has engaged another Advocate of his choice.
