Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is apprehending arrest in connection with FIR No.359/2023, dated 20/07/2023, registered at Omerga Police Station, District Osmanabad, for the offences punishable under sections 143, 147, 148, 149, 452, 326, 324, 323, 427, 504, 506, 436 of the Indian Penal Code. 3.
This Court, by order dated 06/05/2024, granted interim protection to the applicant.

The learned Counsel for the applicant submits that the investigation is complete, and the charge-sheet has been filed. The case against the applicant is that the applicant, along with 19 others, trespassed into the house of the informant and assaulted the informant and his family members. It is alleged that the applicant and co-accused were aggrieved by the informant's actions against their panel in the Grampanchayat election. They allegedly abused the informant and his family members, assaulted them, razed down the tin shed, damaged articles, and set them on fire. 1 of

The learned APP submits that the informant sustained grievous injuries, which are attributable to the present applicant, while the other victims sustained simple injuries.

Since one injury is grievous while the other two are simple in nature, and the applicant has cooperated by attending the police station, with the investigation complete and the charge-sheet filed, no further custodial interrogation is required. Accordingly, the interim protection granted to the applicant is confirmed.

In view of the above, the application is allowed in the following terms: - i] In the event the applicant is arrested in connection with FIR No.359/2023, dated 20/07/2023, registered at Omerga Police Station, District Osmanabad, for the offences punishable under sections 143, 147, 148, 149, 452, 326, 324, 323, 427, 504, 506, 436 of the Indian Penal Code, he shall be released on bail on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court.
ii] The applicant shall attend the police station as and when called by the police.
iii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. iv] The applicant shall co-operate with the investigation and also 2 of
947 ABA 545-2024 in the proceedings before the trial Court.

In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 9.
It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.

The application stands disposed of.
