Heard learned Counsel appearing for the applicant and learned Counsel for the Insurance Company. 2.

Taking into account the defenses raised by the Insurance Company, I deem it appropriate to allow the applicants / claimants to withdraw 50 % amount deposited by the appellant Insurance Company on submitting an undertaking that in the event any adverse order is passed against them, they will re-deposit the amount withdrawn by them within two months on passing such order. Balance 50 % amount to be invested in Fixed Deposit Receipt of any nationalized Bank till decision of the appeal.

Civil Application stands disposed of.
